Terms and Conditions
Preamble
The following Terms and Conditions govern the contractual relationship between Stargate Innovationhub, Florian Aboutara (hereinafter "Weddy" or "Provider") and the user (hereinafter "Customer") of the platform weddysuite.com.
Weddy provides the Customer with a platform for creating a personalized wedding homepage, including features such as guest management, RSVP, gallery, seating planning, and other planning tools.
§ 1 Scope
- These Terms apply to all contracts between Weddy and the Customer regarding the use of the platform weddysuite.com.
- The languages available for contract conclusion are German and English. In case of contradictions between language versions, the German version takes precedence.
- Deviating conditions of the Customer are not recognized unless Weddy expressly agrees to their validity in writing.
§ 2 Contract Conclusion
- The contract for the use of the free Basic version is concluded upon successful registration of a user account.
- Booking paid services (Pro or Premium) is done by selecting the desired plan and completing the order process. The contract is concluded with the confirmation of the order by Weddy.
- The Customer must be at least 18 years old for registration.
§ 3 Service Description
- Weddy offers three plans:
- Basic (free): Basic features incl. subdomain, 20 photos, 3 themes, 1 team member
- Pro: Extended features incl. unlimited photos, all themes, seating planner, budget planner, 3 team members
- Premium: All Pro features plus custom domain, AI assistant, analytics, unlimited team members, priority support
- The detailed service description is available on the pricing page (weddysuite.com) and applies at the time of booking.
- Weddy strives for platform availability of 99% on an annual average. Maintenance work will be announced in advance where possible.
§ 4 Prices and Payment
- Current prices are available on the website. All prices are final prices. According to § 19 UStG, no VAT is charged.
- Paid plans are available with the following durations: 6 months, 1 year, 2 years. Payment is made in advance for the entire duration.
- Payment is processed through the payment service provider Stripe. Available payment methods are displayed during the checkout process.
- In case of payment default, Weddy reserves the right to restrict access to paid features.
§ 5 Duration and Termination
- The contract for the free Basic version runs indefinitely and can be terminated at any time by deleting the account.
- Paid plans have the duration selected at booking (6 months, 1 year, or 2 years).
- Termination of a paid plan is possible at any time and becomes effective at the end of the paid period. Within the first 14 days after contract conclusion, the contract can be withdrawn and the amount already paid will be fully refunded. After the 14-day period expires, no refund of amounts already paid will be made.
- Exception: When purchasing a custom domain through Weddy, withdrawal is excluded, as domain registrations take effect immediately and cannot be reversed. This is expressly confirmed during the ordering process.
- Automatic renewal does not take place. The Customer will be informed before the end of the period about the upcoming termination and can manually extend the plan.
- The right to extraordinary termination for good cause remains unaffected.
§ 6 Customer Obligations
- The Customer is responsible for all content they post on their wedding homepage.
- The Customer undertakes not to post any illegal content, in particular content that:
- violates applicable law
- infringes third-party rights (e.g., copyrights, personal rights)
- is harmful to minors, pornographic, or glorifies violence
- is discriminatory or incites hatred
- The Customer is obliged to keep their access data secret and prevent unauthorized access by third parties.
- When using photos of third parties, the Customer must ensure that they have obtained the necessary consents.
- The Customer indemnifies Weddy against all third-party claims arising from violations of these obligations.
§ 7 Custom Domains (Premium)
- In the Premium plan, the Customer can use a custom domain for their wedding homepage.
- When registering a domain through Weddy, it is registered in the Customer's name. The Customer is the owner of the domain.
- The Customer is responsible for choosing the domain name and warrants not to infringe any third-party rights.
- Upon termination of the contract, the Customer can transfer the domain to another provider. Weddy supports the transfer upon request.
§ 8 Usage Rights
- The Customer grants Weddy the right to store, reproduce, and make publicly accessible the content posted by the Customer for the duration of the contractual relationship.
- The rights to the content created by the Customer remain with the Customer.
- Weddy grants the Customer a simple, non-transferable right to use the platform for the duration of the contractual relationship.
§ 9 Liability
- Weddy is liable without limitation for intent and gross negligence as well as for injury to life, body, or health.
- In case of slight negligence, Weddy is only liable for breach of essential contractual obligations (cardinal obligations), the fulfillment of which enables the proper execution of the contract in the first place. Liability is limited to foreseeable, contract-typical damage.
- Liability for data loss is limited to the typical recovery effort that would have occurred with regular and appropriate backup copies.
- Weddy assumes no liability for content posted by customers or their guests.
§ 10 Data Protection
The processing of personal data is carried out in accordance with our Privacy Policy, which is available at weddysuite.com/privacy.
§ 11 Changes to Terms
- Weddy reserves the right to change these Terms, insofar as this is reasonable for the Customer. This applies in particular to changes in the legal situation, technical changes, or new features.
- The Customer will be informed of changes at least four weeks before they take effect by email. If the Customer does not object within this period, the amended Terms are deemed accepted.
§ 12 Final Provisions
- The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
- If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction is Wiesbaden.
- The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/. We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
- Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected.
